Common Questions

Expert Witness FAQ

01 What is an expert witness in digital forensics?
An expert witness is a person with specialist knowledge who is permitted by a court to give opinion evidence — not just factual evidence — in their area of expertise. In digital forensics, this means giving evidence about how data was extracted, what it shows, and what conclusions can legitimately be drawn from it.
02 Can you be cross-examined on your findings?
Yes — and we welcome it. Our methodology is documented, repeatable, and transparent specifically so it can withstand cross-examination. We have given testimony in numerous proceedings and are experienced at explaining technical evidence clearly to judges and magistrates.
03 What if the other side has their own expert?
We can provide rebuttal analysis of opposing expert reports — identifying methodological errors, unsupported conclusions, or gaps in the opposing analyst's findings. We have reviewed and rebutted expert reports in civil and family court matters.
04 How is an expert witness report different from a standard forensic report?
An expert witness report includes the analyst's opinions and conclusions in addition to the raw findings. It is structured specifically to comply with the rules of the relevant court or tribunal and includes the analyst's qualifications, methodology, and a formal declaration of independence.
05 Do you work with the instructing solicitor directly?
Yes. We prefer to engage directly with the solicitor or barrister to understand what the report needs to address, what the opposing evidence is, and what questions we may face in cross-examination. Good communication before the report is finalised produces better results.
06 How quickly can you produce an expert witness report?
Standard turnaround is 5–10 business days from receipt of all relevant materials. Urgent matters can be accommodated — contact us to discuss your deadline.
